Description of products

Each product is sold subject to its product description. We take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered on to the system.

Prices

  1. The prices, payable for goods that you order, are as set out on our website or as quoted by our representative on the telephone. Prices quoted on the website are subject to change and are indicative only. If we have mistakenly under-priced a product we will not be liable to supply that product at the stated price. We will contact you to notify you of our mistake and amend your order for your confirmation.
  2. All prices are in £ sterling and inclusive of VAT but exclude delivery costs.
  3. Delivery costs are additional to the prices quoted for the goods and are detailed on the website

Payment

We accept payment by cheque and all major debit and credit cards except American Express. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If payment is not authorised we will not be liable for any delay or non-delivery.

The contract between us

We must receive payment in full of the goods you order before your order can be dispatched. This will take place after your debit/credit card has been authorised for payment or after your cheque has been cleared. Please note a binding contract of sales of goods between you and us comes into effect upon confirmation of the order by us or at the latest at the time of dispatch. We reserve the right to refuse to process any order in our absolute discretion.

Acceptance of the order

For web orders, we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form.

For telephone orders, we will confirm your order has been accepted during the call and refer you to website for the terms and conditions that apply to that order.

Cancellation of the order by us

We reserve the right to cancel the contract between us if:

  1. The product you ordered is unavailable from stock
  2. We do not deliver to your area
  3. The identification of a price or product description error
  4. We are unable to obtain authorisation for your payment

Cancellation of the order by you

You may cancel your contract with us for the goods you have ordered up to the end of the seventh working day from the date you receive the ordered goods. If you wish to cancel the contract you must do so by email: sales@ironandstone.co.uk or by fax: 020 7722 2198. We will re-credit the sum debited from your credit card as soon as possible and within 30 days of your order provided that the goods have been returned by you and received by us in the condition they were in when delivered to you.

If you have received the goods before you cancel your contract, you must send the goods back to our despatch address at your own cost and risk, in an unused condition, in their original packaging and with complete documentation.

Delivery of Goods

At present we are delivering to UK and Northern Ireland only.

Delivery of the goods will be made to the address you give us at the time of placing your order. Your full delivery address and postcode must be given with the order. For precaution against fraud we regret we can only deliver to the cardholder’s address. For subsequent orders (if for gifts) we may be able to deliver to a different address providing you contact us by phone.

Delivery will be made as soon as possible after your order is accepted and within 30 days of the acceptance of the order

Please check your goods are in good condition and only sign for them if they are undamaged or mark them clearly “Goods Damaged”. Failure to do so may result in us being unable to replace goods damaged in transit.

Damage, Loss or delay of Delivery

If you have received an incorrect item or faulty item, please notify us in writing within 7 days of receiving the item, giving your order number and date of purchase. If there is a loss or delay of delivery please notify us in writing within 30 days of placing the order.

Refund Policy

If a faulty item is delivered or is not the item ordered, the customer will be offered a replacement. If this is not satisfactory a full refund will be offered. Faulty or incorrect items must be returned within 14 days if a refund is to be issued. If the goods being returned are simply not wanted, the purchaser will be responsible for postage. The goods must be insured and trackable.

Privacy Policy

Iron and Stone Garden Products do not disclose buyers’ information to third parties except for purposes of delivery. Customers’ contact details only will be held on the Iron and Stone Garden Products Ltd mailing list unless otherwise requested. We may wish to contact customers in future about new products, special offers or promotions. If you do not wish to receive these, please let us know at: sales@ironandstone.co.uk or by fax.

Intellectual Property Including Copyright

All intellectual property rights in the garden products of Iron and Stone Garden Products Limited and the website including the designs, look and feel, graphics, text, photographs, images and these Terms and Conditions are reserved and copyright of Iron and Stone Garden Products Limited unless expressly stated otherwise. Iron and Stone is a trading style and mark of the Iron and Stone Garden Products Limited business. Iron and Stone is the registered owner of Patent Design No:3022245.

You may only download the materials on the website for the purpose of completing your purchase. Any unauthorised use of our designs, content, photographs and images by third parties will be referred to our lawyers.

Technical Issues

Iron and Stone aim to ensure that our website is fully operational and free from error. We make every effort to ensure the accuracy and availability of the information displayed on the website but we cannot be held responsible for losses, which you may incur in reliance upon this information or availability


Limit of Liability

Iron and Stone’s liability to you shall be limited in contract and/or tort to the value of your order only.

Statutory Rights

Nothing in these terms and conditions shall operate or is intended to operate to exclude our liability for death and personal injury arising as a result of our negligence (This is a statement we are required to make by law).

The consumer’s statutory rights (including the right to cancel) remain unaffected by these terms and conditions.
